Improving Canada’s Family Justice System

Our Government is proposing several changes to federal family law, in order to strengthen our family justice system and to put Canadian children first.

Bill C-78 is the first major update of Canada’s family laws in 20 years, and proposes changes to the Divorce Act; the Garnishment, Attachment and Pension Diversion Act (GAPDA); and the Family Orders and Agreements Enforcement Assistance Act (FOAEAA). The proposed changes include:

  • When parents divorce, decisions regarding their child(ren) will take into account every child’s specific needs and circumstances
  • Courts must take into account a child’s heritage and upbringing (ex. language, culture, sprituality) when making parenting arrangement decisions
  • Creating measures to deal with family violence, ensuring family violence is taken into account when determining parenting arrangements
  • Creating more tools to enforce child support
